Notwithstanding any general or special law to the contrary, only for the hospital rate year commencing October 1, 2007, hospitals may appeal to the division of health care finance and policy to receive Medicaid hospital rate increases without meeting the quality standards and achieving performance benchmarks established by the executive office of health and human services under section 13B of chapter 118E.
